EBay Expecting More Lawsuits Over Counterfeits

Online auction giant eBay Friday told regulators a German court last month ruled it must take “reasonable measures” to prevent auctions of counterfeit luxury items. The decision follows a six-year-old lawsuit Rolex brought against eBay in Germany.

“The court’s decision found that eBay must take reasonable measures to prevent recurrence once it is informed of clearly identified infringement, and that eBay may in certain circumstances be liable upon first notice of infringement,” eBay wrote in a recent financial report filed with the Securities and Exchange Commission (SEC).

Noting the impact the ruling might have, eBay said it expects more German lawsuits, but they won’t force significant changes.
